Bookmark or Share- Can you sell a house in NJ if guest house has a Cesspool? (commission ...An interesting thought would be whether or not the guest house cesspool could simply be properly abandoned and the guest house no longer considered habitable which could potentially save the OP money on the transaction in the short run and on property taxes in the long run-assuming he had no need for the guest house to actually be a guest house.
- Anyone with a cesspool sell their home since 2012? (West Milford ...I apparently had my head in the sand and was unaware of the NJ law passed in 2012, making it illegal (except in a very few specific circumstances) to sell a house with a cesspool. Either the seller has to replace the cesspool with a septic system before closing, or the buyer has to replace it shortly after closing (I think within 60 days).

Suffolk county also has a program for people wanting to try new systems that are not supposed to leak anything at all into the ground, but I think these are like $20k, but the county kicks in $10k or so - not sure on those details.
