State Sen. Jason Pizzo files lawsuit claiming FDOT’s marijuana ad is ‘misuse of taxpayer funds’

State Sen. Jason Pizzo filed a lawsuit Friday seeking to halt a Florida Department of Transportation public service announcement which states that “DUI crashes increase in states with legalized marijuana.” The lawsuit, filed in Leon County circuit court, argues that the PSA is a thinly veiled political ad attempting to influence voters against Amendment 3, the ballot initiative seeking to legalize marijuana, and asks for a temporary injunction over what it claims is an “unconstitutional misuse of taxpayer funds.” Pizzo’s complaint comes days after Smart and Safe Florida, the group behind the ballot initiative, sent dozens of cease-and-desist letters to TV stations over the PSA, accusing them of broadcasting “taxpayer funded political propaganda.” The letters came from the group’s attorney, Glenn Burhans, who is also the attorney representing Pizzo in the lawsuit. Pizzo represents districts in Broward and Miami-Dade and will soon assume the role of Florida Senate Democratic leader. The PSA, described in the complaint as an “Election Ad,” begins with a driver exhaling a cloud of smoke and then getting into a crash.
