The state Appellate Court had overturned Braswell's conviction in 2010 when he was sentenced to 12 years in jail and eight years of special parole. Braswell appealed the conviction on the grounds the judge unconstitutionally denied his motion to dismiss his public defender and be allowed to defend himself at trial.
