City Attorney: Procedure used to kill Santolina legislation wasn't legal

It wasn’t legal for Albuquerque city councilors to block the introduction of Santolina legislation earlier this month, according to a new legal opinion. In a two-page memo, City Attorney Jessica Hernandez said the council’s rules don’t allow councilors to kill a bill before it’s even introduced for consideration. She doesn’t mention the Santolina legislation by name, but the issue arose two weeks ago when councilors voted 6-3 to block legislation sponsored by Councilor Isaac Benton. Hernandez examined the parliamentary question at the request of Benton.
