An attorney for former sheriff’s deputy Maxine Evans today asked a judge to consider a probated-suspended sentence with community service for her convictions stemming from the in-custody death of Mathew Ajibade. Evans’ lawyer, attorney Bobby Phillips, contends in a sentencing memorandum that “a fair and just sentence” in the case would be five years on each count to run at the same time with two years on probation and three suspended. That would include 120 hours of community service and a $1,000 fine, Phillips said. Evans, 57, faces a maximum sentence of 20 years in prison – or a minimum of a suspended term with a possible fine – for her convictions on charges of public records fraud by falsifying a restraint chair log and three counts of perjury before the Chatham County grand jury in June.
