A state appeals court has thrown out a gun conviction in a stop and frisk case after finding cops didn't have a legit reason to question the gunman in the first place. In a 3-2 decision, a panel of state Appellate Division judges dismissed all charges against Jeffrey Johnson, who was found with a gun in his coat pocket in a Bronx housing project back in 2007.
