ALBANY -- A man who donated sperm to a married lesbian couple has no right to demand a genetic test to assert his claim to be their child's father, a state appeals court determined Thursday, overturning the determination of a Family Court in the Southern Tier. Delving into an emerging area of law, a five-judge panel of the Appellate Division of state Supreme Court unanimously affirmed the couple's right through their legal marriage to be the presumed parents of the child, and stated further that a genetic test would not be in the child's best interests.
