John Marvel, 21, was allegedly racing another vehicle and had a blood alcohol concentration of .133 percent when he hit and killed 22-year-old Andrew Shada with his car, according to Marvel's arrest affidavit.He was arrested on suspicion of vehicular homicide, driving under the influence, reckless driving and other traffic charges, Colorado Springs police said.Colorado drivers are considered to be driving under the influence with a blood alcohol level of .08 percent, and driving with ability impaired at .05 percent.When questioned about an odor of alcohol on his breath, Marvel admitted to police that he had consumed a shot of American Turkey brand whiskey about an hour and a half before the incident.Read more on Colorado Springs Gazette
